Mediation

David brings a wealth of experience to the mediation table, drawing on his background as a former judge, attorney, and insurance claims adjuster to help the parties find common ground outside of the courtroom. With his significant expertise, David can guide complex discussions when he serves as a mediator, David is a neutral facilitator who fosters a confidential and constructive environment where all voices can be heard. Through active listening, insightful questioning, and offering insightful perspectives from his experience, David aids in crafting equitable solutions tailored to avoid the angst and uncertainty of a public trial. Should mediation not result in a settlement, the parties will continue to litigate their case in the trial court.

Arbitration

When finality is paramount in resolving disputes, David’s role as an arbitrator becomes invaluable. Arbitration presents a path to a binding resolution, agreed upon contractually, allowing the parties to conclude their disagreements with certainty and finality. An arbitration setting is akin to a bench trial except that the process is streamlined in a private environment and without the need for a court reporter. This ensures a swift and discreet resolution without all the formalities of litigation in a courtroom. His decision is conclusive, offering closure with the assurance that appeals are exceptionally limited, preserving the integrity and finality of the arbitration outcome.

Trial By Special Judge (a/k/a Private Judge)

Texas law provides a streamlined legal avenue through the appointment of a special judge, enabling parties to bypass the delays of conventional litigation. As a seasoned former judge, David is uniquely qualified to serve in this role, assuring an expedited and focused trial. His commitment to fairness ensures that even in this private setting, the gravity and integrity of a courtroom trial are preserved. Parties benefit from David’s reputation for fairness in decision-making, which helps produce a swift resolution that reduces the uncertainty and wait times associated with standard court proceedings. While his decisions are amenable to appeal, ensuring accountability, David follows the law and ensures the trial is conducted according to the rules. As a special judge, David delivers both the efficiency of a private trial and the robust framework of traditional litigation.

Mini trial

Texas law offers an innovative dispute resolution process in the form of mini-trials, as per Section 154.024 of the Texas Civil Practice and Remedies Code. In this process, parties present their cases succinctly before an impartial third party like David, who assists in defining the issues and fostering realistic settlement negotiations. With his seasoned expertise, David not only facilitates these mini-trials but can also provide an advisory opinion on the case’s merits, drawing from his extensive legal experience. This opinion, while insightful, is not binding unless the parties choose to make it so through a written settlement agreement. David’s involvement in mini-trials ensures a streamlined, focused approach, offering clarity and efficiency. His expert advisory is particularly beneficial for swiftly and effectively resolving complex legal matters.
